Discusses enforcement guidance issued by the EEOC (U.S. Equal Employment Opportunity Commission) on May 24, 2007 for its employees on the treatment of workers with caregiving responsibilities. As indicated, “The Guidance states that, while the status of caregiver is not, itself, a protected class under either Title VII or the ADA [Americans with Disabilities Act], treating workers differently based on stereotypes and assumptions regarding their caregiving responsibilities can constitute unlawful discrimination based on sex or race under Title VII or violate the ADA’s prohibition on discrimination based on association with a disabled person.”
