A critical examination of the Guardianship laws and regimes in the 50 U.S. States, with recommendations and a proposed new model uniform law to address some of the concerns. Considering all the reported problems with Guardianships, gives good reason to avoid the need for a Guardianship by having your elderly loved one sign an enforceable durable power of attorney while he or she is still competent.
